These Terms and Conditions set out the basis on which Waste Removal South Kensington provides waste collection and related services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions, which form a contract between you and us.
1. Definitions
In these Terms and Conditions, the following words have the meanings given below:
Customer means the person, business, or organisation that requests or pays for the waste removal service.
Services means any waste collection, removal, loading, transportation, and associated services provided by us.
Waste means any items, materials, rubbish, junk, debris, or refuse that the Customer asks us to remove, subject to applicable waste regulations and restrictions.
Order means a confirmed booking for our Services, whether made by phone, email, online form, or in writing.
2. Scope of Services
We provide waste removal and collection services within South Kensington and surrounding areas, subject to availability and our operational limits. The exact scope of the Services will be agreed at the time of booking based on the information you provide about the type and volume of Waste, the collection address, and access conditions.
We reserve the right to refuse to collect any Waste that is hazardous, prohibited by law, unsafe to handle, incorrectly described, or beyond the capacity of our equipment or staff to manage safely.
3. Booking Process
You may request a booking by contacting us via telephone, email, or any booking system we may provide. When you make a booking request, you must provide accurate and complete information, including but not limited to:
1. Your name, contact details, and collection address.
2. The type of premises, for example residential or commercial.
3. The approximate volume, type, and nature of the Waste.
4. Any access restrictions, parking limitations, or special requirements.
5. Your preferred date and time window for collection.
We will provide an estimated price based on the information you supply. This estimate may be given verbally or in writing. The estimate is not a fixed quotation and may change if the actual Waste or access conditions differ from your description.
Your booking becomes an Order only when we confirm acceptance of your request, allocate a collection time, and you accept our pricing and these Terms and Conditions. We reserve the right to refuse or cancel any booking at our discretion, subject to any payments already made being refunded as appropriate.
4. Access and Customer Responsibilities
You are responsible for providing safe, clear, and reasonable access to the collection point at the agreed time. This includes ensuring:
1. Suitable parking is available for our vehicle, with any required permits or permissions in place.
2. The Waste is accessible, not obstructed by other items, locked gates, or blocked entrances.
3. The working area is reasonably safe and free from hazards, including unsafe structures, dangerous animals, or unsafe materials.
If we are unable to carry out the Services because of inadequate access, incorrect information, or unreasonable safety risks, we may charge a call-out fee or a proportion of the agreed price to cover our costs.
5. Pricing and Quotations
Unless expressly stated otherwise, all prices are quoted in pounds sterling and are exclusive of any applicable taxes or charges which will be added where required by law.
Prices may be based on factors including volume of Waste, weight, loading time, type of materials, and distance. We may confirm the final price once our team has inspected the Waste on site. If the actual Waste volume, type, or access conditions vary from your description, we may adjust the price accordingly. You will be informed of any material price changes before work proceeds.
We may, from time to time, offer promotional pricing or discounts. Such offers are subject to change or withdrawal at any time and are only valid when explicitly confirmed at the time of booking.
6. Payments and Invoicing
Unless we agree otherwise in writing, payment is due on completion of the Services on the day of collection. We accept payment methods that we notify you of when booking, which may include cash, card payment, or bank transfer.
For business or account customers, we may agree alternative payment terms, such as invoicing with payment due within a specified number of days. Any such arrangements must be confirmed in writing. Invoices not paid by the due date may incur late payment charges and interest at the maximum rate permitted by applicable law.
We reserve the right to withhold or delay Services where payment terms have not been met, or where previous invoices remain unpaid.
7. Cancellations and Amendments
You may cancel or amend your booking by contacting us directly. The following terms apply:
1. If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will generally apply.
2. If you cancel within 24 hours of the scheduled collection time, we may charge a reasonable cancellation fee to cover costs incurred, including vehicle allocation and staff scheduling.
3. If our team arrives at the premises at the agreed time and is unable to carry out the work due to your non-attendance, lack of access, or other circumstances within your control, we may charge a call-out fee or a significant proportion of the agreed price.
We will make reasonable efforts to accommodate any requested changes to the date, time, or scope of your booking, but these will be subject to availability and may result in changes to the price or scheduling.
We reserve the right to cancel or reschedule a booking due to circumstances beyond our control, including but not limited to severe weather, traffic disruption, vehicle breakdown, staff illness, or compliance with legal obligations. In such cases, we will notify you as soon as reasonably possible and offer an alternative appointment or a refund of any amounts paid for Services not provided.
8. Waste Types, Restrictions, and Regulations
All Waste collected is handled, transported, and disposed of in accordance with applicable waste management laws, environmental regulations, and duty of care requirements. We aim to recycle or recover materials wherever reasonably practicable in line with local and national guidelines.
The Customer is responsible for declaring any hazardous or special Waste prior to collection. Hazardous Waste may include, but is not limited to, asbestos, chemicals, solvents, oils, batteries, clinical waste, gas cylinders, and certain electrical and electronic items. We may not be licensed or equipped to handle certain Waste streams. In such cases, we may refuse collection or refer you to a specialist provider.
You must not place hazardous or prohibited items in general Waste without prior agreement. If such items are discovered during loading or after collection, we may charge additional fees to cover handling, storage, specialist disposal, or regulatory compliance costs, and we may report any breaches of law to the relevant authorities.
You confirm that you are the owner of the Waste or that you have the owner’s authority to arrange for its removal and disposal. Once the Waste has been loaded onto our vehicle, ownership of the Waste transfers to us, and you will have no further claim to it.
9. Service Standards and Customer Conduct
We will use reasonable care and skill in providing the Services and will endeavour to complete collections at the agreed time or within a reasonable time window. All times given are estimates and may be affected by traffic, access, or operational factors.
Our staff must be treated with courtesy and respect at all times. We will not tolerate abusive, threatening, discriminatory, or violent behaviour towards our employees or contractors. In such circumstances, we reserve the right to withdraw our Services and may notify the appropriate authorities where necessary.
10. Liability and Limitations
We are responsible for any direct loss or damage that is reasonably foreseeable and that arises directly from our failure to perform the Services with reasonable care and skill or from a breach of these Terms and Conditions, subject to the limitations set out below.
We will take reasonable care when loading and removing Waste from your premises. However, you acknowledge that minor scuffs, marks, or wear to paintwork or surfaces may occur in tight or restricted access areas. We will not be liable for such minor cosmetic damage where reasonable care has been used.
We are not liable for any loss or damage that:
1. Is not caused by our negligence or breach.
2. Arises from incomplete or inaccurate information provided by you.
3. Results from unsuitable or unsafe access conditions that you have not remedied or disclosed.
4. Relates to items that you have not clearly identified as not to be removed and which reasonably appeared to be Waste.
We will not be responsible for any loss of profits, loss of business, loss of opportunity, loss of goodwill, or any indirect or consequential losses, whether arising in contract, tort, or otherwise.
Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be limited or excluded by law.
11. Insurance
We maintain insurance cover appropriate to the nature of our Services, including public liability insurance up to a reasonable limit. Details of our insurance cover are available on request. You are responsible for any insurance you consider necessary for your own property or for any business losses, as these are not covered by our standard policies.
12. Data Protection and Privacy
We collect and use personal information such as your name, contact details, and address for the purposes of managing bookings, delivering Services, processing payments, and handling enquiries or complaints. We handle your information in accordance with applicable data protection laws and only retain it for as long as necessary for these purposes or as required by law.
We may share your information with trusted third parties who assist in delivering our Services, such as payment processors or subcontractors, but only to the extent necessary to perform the contract. We do not sell personal data to third parties.
13. Complaints and Dispute Resolution
If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible with details of the issue. We will investigate your complaint and aim to respond within a reasonable time. Where appropriate, we may offer a remedy such as rectification of the issue, a partial refund, or an alternative solution, depending on the circumstances.
Both parties agree to make reasonable efforts to resolve disputes through discussion and negotiation before considering formal legal action.
14. Variations to these Terms

15. Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be removed or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
16. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them, including any non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or their subject matter or formation.
By placing an Order for waste removal or collection services with Waste Removal South Kensington, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
